Sesuit Harbor Zoning – Discussions With the Town Planner

We will be meeting once again on Thursday (January 23rd) at 9 am here at the Town Hall Annex to continue our discussions. This week’s topic will be the Allowed Uses and Accessory Uses Allowed By Special Permit. These sections of the draft by-law have been added to the zoning by-law page linked below:

A.  Allowed uses. The following uses are allowed in the Sesuit Harbor Zoning District:

(1) Commercial marina typically including the following activities and facilities:

(a)    Slips;

(b)   Moorings;

(c)    Docks;

(d)   Ramps;

(e)    Boat Repair;

(f)    Fuel Service;

(g)   Travel lift ;

(h)   Hauling and launching facilities; and

(i)     Single level boat storage both indoor and outdoor.

Commercial marinas may provide for recreational boating and commercial fishing boats as a matter of right, charter fishing boats and excursion boats are accessory uses allowed by Special Permit as discussed below.

(2) Public Marina typically including the following activities and facilities:

(a) Slips;

(b) Moorings;

(c) Docks;

(d) Ramps;

(e) Harbormaster Command Center;

(f) Maintenance Facility for waterways equipment;

(g) Travel lift;

(h) Hauling and launching facilities;

(i) Boat storage, year round, for public boats;

(j) Commercial Pier;

(k) Off-season single level boat storage;

(l) De-watering pit for off-season dredge spoils; and

(m) Emergency boat storage (weather related)

Public marinas may provide for recreational boating and commercial fishing boats as a matter of right, charter fishing boats and excursion boats are accessory uses allowed by Special Permit as discussed below.

(3) Private Yacht Club typically including the following facilities and activities:

(a) Water Orientation;

(b) Social Club;

(c) Yachting and Athletic Activities;

(d) Educational Activities;

(e) Food/bar/restaurant services;

(f) Meeting rooms;

(g) Docks;

(h) Moorings;

(i) ramps;

(j) Playground, tennis courts, and athletic facilities; and

(k) Single level boat storage

B.  Special Permit Accessory Uses: The following Accessory Uses are allowed by a Special Permit by the Planning Board as Accessory Uses to the designated Allowed Uses in the Sesuit Harbor Zoning District.

  1. At a Public Marina, the Charter Fishing Boats and Excursion Boats shall not exceed the number present on ____ 2014 without a Special Permit of the Planning Board.3
  2. At a Commercial Marina the Accessory Uses shall not exceed the configuration present on ___ 2014 as approved by the Dennis Planning Board under Site Plan ___ and the Zoning Board of Appeals Special Permit ____.3
  3. Public and Commercial Marinas shall provide annual reports to the Dennis Planning Board illustrating continued consistency with the standards cited in this Zoning By-law.

Quite likely as we discuss this section we will find it necessary to revisit the Definitions we discussed last week.
